TERMS AND CONDITIONS
(General) 

1. Organisers
The ‘ART of – Events’ (hereafter referred to as “the organisers”) are organised by Klymyuk, ART of.

2. Acceptance of Terms
By submitting an application form, participants or, where applicable, their parents/legal guardians acknowledge full acceptance of these Terms and Conditions.

3. Purpose of the Event
The purpose of ART of – Events (including Ballet Winter and Summer Courses / Stage de Danse d’Été) is to provide an educational and artistic platform for students and professionals to develop their technique and artistry under the guidance of experienced instructors affiliated with prestigious institutions worldwide.
The organisers reserve the right to adjust course content, structure, and scheduling at their discretion to ensure the highest-quality experience.

4. Travel Documents
Participants are solely responsible for obtaining and holding all valid travel and identification documents (e.g. passports, visas, residency permits) required for entry and participation in the host country.

5. Travel and Accommodation
Travel and accommodation arrangements are the responsibility of the participant. The organisers accept no liability for any costs or losses related to travel or lodging.

6. Medical Fitness
Participants may not attend the event if they are injured or otherwise medically unfit to participate.

7. Medical Information
The organisers must be informed in advance of any allergies, medical conditions, or other relevant health issues. Where required, a written medical declaration or letter must be submitted prior to participation.

8. Attire
Participants must attend in appropriate practice attire for their discipline. For ballet events, this includes ballet flats and, for female participants, pointe shoes.

9. Liability for Injury or Loss
Participation is at the participant’s own risk. The organisers are not liable for injuries, damages, or loss of property incurred during the event.

10. Intellectual Property
All artistic works, including choreographies, exercises, and creative outputs developed during the event, are the exclusive intellectual property of Klymyuk, ART of.
Reproduction, sharing, distribution, or use of these materials without prior written consent is strictly prohibited.

11. Withdrawal by Participant
The organisers reserve the right to retain the full participation fee in cases of voluntary withdrawal.

12. Withdrawal Due to Injury or Illness
Refunds may be granted only upon submission of two official medical certificates (not from physiotherapists).
Fee retention applies as follows:
Withdrawal ≥ 3 months before the event: 50% retained
Withdrawal < 3 months before the event: 70% retained
Withdrawal < 1 month before the event: 100% retained (no refund)

13. Event Cancellation or Rescheduling
The organisers reserve the right to modify, reschedule, or cancel the event.
If rescheduled, participants unable to attend the new dates will receive a 50% refund.
If cancellation occurs, participation fees (excluding travel and accommodation expenses) will be refunded.

14. Force Majeure
The organisers are not liable for cancellations or interruptions caused by force majeure (e.g., pandemics, epidemics, natural disasters, government restrictions, or lockdowns). In such cases, no reimbursement of fees is guaranteed.

15. Limitation of Liability
The organisers shall not be liable for any indirect, incidental, or consequential damages arising from participation.

16. Indemnification
Participants (and, if applicable, their parents/legal guardians) agree to indemnify and hold harmless Klymyuk, ART of, its employees, affiliates, and contractors against any claims, damages, or liabilities arising from participation in the event.

17. Changes to Faculty or Artists
The organisers reserve the right to substitute teachers or guest artists in the event of illness or other unavoidable circumstances.

18. Application Fee
The application fee is separate from the participation fee, must be paid upon submission of the application, and is non-refundable.

19. Schedule Publication
The final event schedule will be published or displayed on the first day of the event.

20. Media Services and Copyright
Media service packages (e.g., photo or video shoots) cannot be cancelled less than three months before the event begins.
All images and recordings are protected by copyright law and international treaties. They may be used by participants solely for personal, non-commercial purposes (e.g., portfolios, auditions) and not for commercial use without written consent from both the organisers and the photographer.
Unauthorized reproduction, modification, or distribution is strictly prohibited.

21. Professional Dancer Discount
To qualify for professional dancer discounts, participants must provide proof of a minimum one-year professional dance contract.

22. Payment Terms
The participation fee must be paid within two weeks of receiving confirmation and no later than the stated application deadline. Late payments are subject to a 5% surcharge.

23. Insurance – Travel
Participants are strongly advised to obtain personal travel insurance.

24. Media Usage Rights
All photo and video materials recorded during the event are the property of Klymyuk, ART of and may be used for promotional, educational, or marketing purposes without compensation to participants.

25. Health Insurance
All participants must hold valid health insurance for the duration of the event.

26. Liability Insurance
All participants must hold valid personal liability insurance.

27. Underage Participants
Participants under 18 years of age must submit a signed Parental/Legal Guardian Authorisation form prior to the event.

28. Data Protection
Personal data provided during the application process will be collected, processed, and stored by Klymyuk, ART of in accordance with Swiss law, EU GDPR, and applicable Spanish law.
Data will only be used for event-related purposes and will not be shared with third parties without consent.

29. Refund Processing
Refunds, when applicable, will be processed within 30 days of submission and verification of the required documentation.

30. Governing Law and Jurisdiction
These Terms and Conditions are governed by Swiss law. Jurisdiction is Zurich, Switzerland. Participants also agree to comply with applicable local regulations in the host country (e.g., Spain).

31. Amendments
Klymyuk, ART of reserves the right to amend these Terms and Conditions at any time. Updates take immediate effect upon publication
