(General)
1. The 'ART of - Events' (hereafter referred to as the "organisers") are organised by 'Klymyuk, ART of'.
2. By submitting an application form, participants or their parents/legal guardians acknowledge full acceptance of these Terms and Conditions.
3. The purpose of 'ART of - Events' is to provide an educational and artistic platform for students and professionals to develop their skills under the guidance of experienced instructors affiliated with prestigious institutions worldwide. The event content and structure are subject to change at the organisers' discretion to ensure the highest quality experience.
4. It is the responsibility of participants to obtain and hold all necessary travel and identification documents required for the country where the event is taking place.
5. The organisers are not responsible for the organisation of travel or accommodation for participants.
6. Participants are not permitted to attend the event if they are injured in any way.
7. The organisers must be informed of any allergies or health issues at the time of participation, and an accompanying medical letter must be submitted if necessary.
8. All participants must attend in the appropriate practice attire required for their discipline.
9. The organisers are not liable for any damages, injuries, or loss of property during the event.
10. All artistic content, including choreographies, exercises, and other creative outputs produced during the event, remains the exclusive intellectual property of 'Klymyuk, ART of'. Participants and third parties may not reproduce, share, or use this material without prior written consent.
11. The organisers reserve the right to retain the full participation fee in the event of an applicant's withdrawal.
12. In case of withdrawal due to injury or illness, the following refund policy applies:
- Three months before the event: 50% of the fee will be retained.
- Less than three months before the event: 70% of the fee will be retained.
- Less than one month before the event: No refund will be issued.
To be eligible for a partial refund, the participant must submit medical certificates from two certified specialist doctors. Handwritten or physiotherapist certificates will not be accepted.
13. The organisers reserve the right to modify, reschedule, or cancel the event. If the event is rescheduled, participants who cannot attend on the new dates will be eligible for a 50% refund. If the event is canceled, participation fees (excluding travel and accommodation expenses) will be refunded.
14. The organisers are not liable for force majeure circumstances (e.g., epidemic, pandemic, lockdowns) that may result in the event’s cancellation or interruption. In such cases, no refunds, including course/participation fees, will be provided.
15. The organisers shall not be responsible for indirect, consequential, or incidental damages related to participation in the event.
16. Participants agree to indemnify and hold harmless 'Klymyuk, ART of', its employees, contractors, and affiliates from claims, damages, or losses arising from their participation.
17. The organisers reserve the right to change instructors or artists in case of illness or other unavoidable circumstances.
18. The application fee is separate from the participation fee, must be paid upon submitting the application form, and is non-refundable.
19. The final schedule will be posted on the event’s notice board on the first day.
20. Media service packages (e.g., photo shoots) cannot be canceled later than three months before the event begins. The pictures taken during the Media Service are protected by copyright law and international treaties. Unauthorized reproduction, distribution, or usage without express written permission from the photographer is prohibited.
21. To qualify for professional dancer discounts, participants must currently be or have been under contract with a professional dance company for more than one year.
22. The participation fee must be paid within two weeks of receiving the confirmation letter and no later than the application deadline.
23. Participants traveling internationally are recommended to obtain personal travel insurance.
24. Photo and video content captured during the event remains the property of 'Klymyuk, ART of' and may be used for promotional, educational, and marketing purposes. Participants waive any rights to compensation for such usage.
25. All participants must have valid health insurance.
26. All participants must have valid liability insurance.
27. Participants under 18 years of age must submit a completed and signed 'Authorization for Underage Person' form by their parent or legal guardian before the event starts.
28. By submitting personal information during the application process, participants consent to the collection, processing, and storage of their data by 'Klymyuk, ART of' in compliance with applicable data protection laws. Personal data will be used solely for event-related purposes and will not be shared without prior consent.
29. Refunds, if applicable, will be processed within 30 days after the event’s cancellation or a participant’s withdrawal, upon review and approval of the necessary documentation.
30. These Terms and Conditions are governed by the laws of Switzerland/Zurich. Any legal action related to this Agreement shall be brought exclusively in the courts of Switzerland/Zurich.
31. The organisers reserve the right to update these Terms and Conditions at any time, with immediate effect upon issuance.
